You should be aware that by accessing and/or using the Portal, you acquire the status of user, and from that moment on, you unconditionally accept the content included in this Legal Notice (“General Terms”), as well as any Specific Terms that, in relation to certain services and content of the Portal (“Services”), complement, modify, or replace the former. 

Therefore, we recommend that before using any of the Services, you carefully read both the General Terms and, where applicable, the Specific Terms. 


2. Use of the Portal, its services, and content 

The use of the <1>BamVolea Portal is free of charge for you, without prejudice to the fact that certain services may require us to process your information in order to access them, which we will inform you of in each case. As a user, you agree to:  

(i) Provide truthful information, in case it is necessary to complete an access form for certain services available through our Portal, and keep it updated at all times. You should not forget that you will be solely responsible for any false or inaccurate statements you make, as well as for any damages that, as a result of the information provided, you may cause to BamVolea or to third parties.  

(ii) Use the Portal and the Services without contravening the provisions of these General Terms and any other Specific Terms that govern them, as well as applicable law, good faith, generally accepted practices, and public order. 

(iii) Not use the Portal or its Services for unlawful purposes or in any way that may cause harm to BamVolea or any third party, or that may, in any way, cause damage or prevent their normal functioning. 

We inform you that a series of actions are prohibited in relation to the content of the Portal and/or the Services, such as information, text, graphics, sound and/or image files, photographs, designs, or any other materials (“Content”), as set out below: 

  • Their reproduction, copying, distribution, dissemination, public communication, transformation, or modification, unless authorized by their rightful owners or legally permitted. 
  • Any infringement of the rights of BamVolea or of their rightful owners over them. 
  • Their use for any type of commercial or advertising purposes other than those strictly permitted. 
  • Any attempt to obtain the Content by any means other than those we make available to you or the usual methods on the Internet, provided that such use does not cause any harm to BamVolea.
     


3. Unilateral modification
 

We inform you that, in our desire to improve your user experience, we may modify, without prior notice, the structure and design of the Portal, as well as certain services and content. 

Likewise, we inform you that BamVolea, at any time, may modify these General Terms or, where applicable, the Specific Terms of a Service, and we will inform you through the corresponding notice. Therefore, please remember to review both periodically.  

In any case, the modifications will not apply retroactively.

Consequently, BamVolea assumes no responsibility, whether direct, indirect, or subsidiary, for any damages and/or losses that may arise from third-party actions such as access, maintenance, use, quality, legality, reliability, or usefulness of the content, information, communications, opinions, statements, products, and/or services existing or offered on those websites, as they are not managed by BamVolea, even though, in order to keep you informed, BamVolea provides access to them through the Portal.  

4.2. Links to the Portal from third parties 

If you wish to create, or do create, a link from a website or Internet portal to any of the pages of the Portal, you must comply with the following conditions: 

  • Ensure that any link you create to the Portal directs only to its homepage or to the main pages of its sections.

6. User liability for damages and losses

This liability shall also extend to the use, by you or any third party, of access credentials or similar identifiers, where applicable, assigned for access to the Portal or its Services.  

It is important that you are aware that if you breach these General Terms or any applicable Specific Terms, we may deny you access to our services and content without prior notice. 


7. Exclusion of warranties and liability 

BamVolea provides you with access to the Portal, its Content and/or Services with a reasonable level of skill and diligence, and we hope you enjoy using it—and, if you wish, you can share your experience with us. However, we cannot offer any guarantees or accept any liability, under any circumstances, for any damages or losses of any kind that may arise from:

  • The lack of usefulness, suitability, or validity to meet your needs, activities, specific results, or expectations.

All trademarks, trade names, or distinctive signs of any kind appearing on the Portal (“Trademarks”) are the property of BamVolea or third parties, and use of or access to the Portal and/or Services shall not be understood as granting you any rights over such Trademarks. The Trademarks are subject to applicable intellectual and industrial property laws, and their reproduction or use without the authorization of their owner is prohibited.  

All Content, including the Portal itself, is the intellectual property of BamVolea or third parties; therefore, under no circumstances shall it be understood that, pursuant to this Legal Notice, any exploitation rights existing or that may exist over the Content have been granted to you, beyond what is strictly necessary for the proper use of the Portal and the Services. 

If you believe that your legitimate rights have been infringed by the inclusion of certain content on the Portal, you must notify BamVolea of this circumstance, indicating: 

  • Your personal data. If the claim is submitted by a third party other than the data subject, they must indicate the capacity in which they are acting.  
  • Identification of the Content protected by industrial or intellectual property rights and its location on the Portal (including the URL link). 
  • Evidence of the aforementioned industrial or intellectual property rights. 
  • An express statement in which the claimant assumes responsibility for the accuracy of the information provided in the notification. 

Any citation or reference to third-party intellectual or industrial property rights included in the Portal implies recognition by <1>BamVolea of the corresponding industrial and intellectual property rights in favour of their respective owners. Their inclusion or reference in the Portal does not imply any sponsorship or recommendation by BamVolea of the referenced trademarks or content. The legitimacy of the intellectual or industrial property rights corresponding to Content provided by third parties is the sole responsibility of those third parties.  

As the sole owner of the intellectual property rights of the Portal, BamVolea has the exclusive right to exercise the rights derived therefrom, and consequently, is the only party that may authorize any activity arising from the exploitation rights, in particular the rights of reproduction, public communication, distribution, making available to the public, or transformation, in whatever format is used.

Aligned with our culture and principles as a Group, we aim for all people, regardless of their condition, abilities, or technological equipment, to be able to access the Portal, its Content and/or the Services. For this purpose, BamVolea has adopted a series of measures that we hope will contribute to this goal:

  • Use of different languages. 
  • Logical order of presentation of on-screen elements. 
  • Alternative text in images. 


11. Applicable Law and Jurisdiction 

Spanish law shall apply to any dispute or conflict arising from these conditions or from the use of the Portal, its Content, or its Services, or related thereto, without giving effect to any conflict of law provisions that may otherwise apply. Both BamVolea and you agree to submit to the exclusive jurisdiction of the courts of your place of residence, provided it is located in Spain, to resolve any claims arising from these General Terms, any Specific Terms of the Services, or related matters. However, if your place of residence is not located in Spain, both you and <1>BamVolea<2> agree to submit to the exclusive jurisdiction of the courts of Madrid.
